I] ENVIRONMENT MEANING-

The term ‘Environment’ is derived from the French word environ, which means “to surround.” The primary concern of environmental studies is the study of man’s surroundings. However, man cannot exist in isolation from other living beings, such as animals and plants, which surround him. The very existence of man and every other creature depends upon the environment. All creatures derive their necessities from the environment, i.e., nature. Water, air, soil, forests, and animals are essential components of nature necessary for the existence of all living beings. The environment serves as the life-support system for all creatures. In general parlance, the term “environment” is often referred to simply as “nature.”

II] ENVIRONMENT DEFINITIONS-

Below are some of the standard definitions of the term ‘Environment’:

A) According to the Encyclopedia Britannica:

“The expression ‘Environment’ connotes the entire range of external influences acting on an organism, both physical and biological, and other organisms, i.e., forces of nature surrounding an individual.”

B) According to Section 2(a) of the Indian Environment (Protection) Act, 1986:

“'Environment' includes water, air and land and the inter-relationship which exists among and between water, air and land, and human beings, other living creatures, plants, micro-organism and property.”

C) According to C.C. Park:

“Environment refers to the sum total of conditions which surround man at a given point in space and time.”

The environment comprises both living (biotic) and non-living (abiotic) components of the planet Earth. The third crucial component of the environment is energy. The abiotic (non-living or physical) environment can be further divided into three states: (i) solid, (ii) liquid, and (iii) gas.

To understand the complex concept of the environment, we must familiarize ourselves with the following terms:

1. Ecosystem:

An assemblage of plant and animal species existing in a common area and mutually affecting each other is called a ‘biotic community’. The interaction of such biotic communities with their physical environment constitutes an ecosystem. A regional scale of ecosystems that occur under similar climates and share similar characteristics and vegetation structures is called a biome. The Arctic tundra, deserts, and tropical rainforests are prominent examples of biomes. According to the United States Council on Environmental Quality, “the interdependence of living and non-living parts, i.e., man, animals, plants, forests, lakes, etc., makes an ecosystem.” Ecosystems are functional and dynamic rather than static. A small change occurring in one part of the ecosystem radiates throughout the entire system; however, the system always seeks to maintain ecological stability (homeostasis) as far as possible.

2. Ecology:

Ecology is the study of ecosystems to determine how they are organized, how the creatures within them interact, and how the entire system functions. The dictionary defines ecology as “a branch of biology dealing with the relations of living organisms to their surroundings, their habits, and their modes of life.”

3. Biosphere:

The ‘Biosphere’ is the life-supporting layer that surrounds the Earth and makes plant and animal life possible. It is the zone of the Earth and its atmosphere inhabited by living beings. The biosphere consists of all living organisms (the biotic component), the physical environment (the abiotic component), and the energy component. In essence, it is the sum of all Earth's ecosystems.

III] SUSTAINABLE DEVELOPMENT

In environmental law, meeting the needs of the present generation without compromising the ability of future generations to meet their own needs is called ‘sustainable development’.

In the landmark case of Karnataka Industrial Areas Development Board v. C. Kenchappa

The Karnataka High Court had initially issued directions to the concerned authority to maintain a one-kilometer "green zone" from village limits to preserve ecological equilibrium. However, the Supreme Court, on appeal, quashed these rigid directions, emphasizing a fine balance between industrial development and eco-protection under the principles of sustainable development.

Today, it is vital to emphasize sustainable development. This is evident from the numerous directions and doctrines (like the Public Trust Doctrine and Polluter Pays Principle) formulated by the Supreme Court of India to protect the environment.

IV] OBJECTS OF ENVIRONMENTAL PROTECTION

A healthy environment is essential for the survival of human beings, animals, and plants. The very existence of all beings depends upon the quality of the surrounding environment. A clean environment is necessary for the all-round development of human beings, as individuals require unpolluted air to breathe, uncontaminated water to drink, nutritious food to eat, and hygienic conditions to live in.

Contamination of these core elements severely stunts human and ecological development. Today, vital necessities for survival—air, water, and soil—are heavily polluted. Due to this degradation, we face severe global crises such as acid rain, climate change, water scarcity, the mass extinction of species, biodiversity loss, and ozone layer depletion. Contamination of our life-support system has caused widespread physical illnesses and chronic diseases. Therefore, there is an urgent, undeniable need to protect the environment.

V] ENVIRONMENTAL POLLUTION

The word ‘pollution’ is derived from the Latin term pollutus, which means to spoil, defile, make foul, or corrupt. According to the International Law Association, ‘pollution’ means:

"...any introduction by man, directly or indirectly, of substance or energy into the environment resulting in deleterious effects of such a nature as to endanger human health, harm living resources, ecosystems and material property, and impairs amenities or interferes with other legitimate uses of the environment."

While human life fundamentally depends on nature, the post-Industrial Revolution era triggered a reckless, exponential exploitation of natural resources. This aggressive development has severely compromised environmental safety. For instance, a vast majority of India’s population lacks access to safe drinking water, while the excessive use of chemical fertilizers in farming introduces harmful toxins into the food chain. Industrial discharge, vehicular emissions, and atomic waste continuously pollute the air and atmosphere.

1. Environmental Pollutant [S. 2(b)]:

Under the Environment (Protection) Act, 1986, an environmental pollutant means any solid, liquid, or gaseous substance present in such concentration as may be, or tend to be, injurious to the environment.

2. Environmental Pollution [S. 2(c)]:

This means the presence of any environmental pollutant in the environment.

VI] MAJOR TYPES OF POLLUTION

1. Air Pollution:

Humans and other creatures cannot survive for more than a few minutes without air. Today, atmospheric air is heavily contaminated, primarily by toxic smoke and gases released from factories, thermal plants, and motor vehicles, causing severe respiratory and systemic diseases.

2. Water Pollution:

Water covers about 71% (nearly three-quarters) of the Earth's surface. "Water Pollution" is legally defined as the contamination of water or the alteration of its physical, chemical, or biological properties, or the discharge of sewage, trade effluents, or toxic substances into water bodies that creates a public nuisance or renders the water harmful to public health, domestic, agricultural, industrial uses, or aquatic life.

3. Noise Pollution:

Noise is defined simply as unwanted or excessive sound. It is classified into: (i) Industrial sources (machinery, manufacturing units, generators) and (ii) Non-industrial sources (vehicles, loudspeakers, construction activities, aircraft, and railways).

4. Land Pollution:

Soil is the baseline for critical human activities like agriculture, forestry, mining, and housing. Degradation of land quality is caused by accelerated soil erosion, deforestation, excessive application of chemical fertilizers/pesticides, industrial wastewater runoff, and the dumping of urban plastic and industrial solid waste.

5. Radioactive Pollution:

Elements like radium and uranium emit invisible, highly energetic particles known as ionizing radiation. This emission is called radioactivity. These radiations are biologically hazardous, mutating cells and inducing terminal diseases like cancer. Nuclear power plant accidents, atomic bomb testing, improper disposal of nuclear waste, and medical radioactive materials are primary causes.

Note: To combat these issues, India has enacted comprehensive legislation, including the Water (Prevention and Control of Pollution) Act, 1974; the Air (Prevention and Control of Pollution) Act, 1981; the Wildlife (Protection) Act, 1972; the Insecticides Act, 1968; and the umbrella Environment (Protection) Act, 1986.

VII] CAUSES OF ENVIRONMENTAL POLLUTION

The factors causing environmental degradation can be categorized into two groups:

A) Natural Causes:

Droughts, floods, cyclones, earthquakes, volcanic eruptions, hurricanes, and natural epidemics are primary natural causes of ecological imbalance. Because human beings have minimal control over these spontaneous acts of nature, environmental law focuses primarily on regulating human behavior.

B) Man-Made Causes:

Human activities are overwhelmingly responsible for modern environmental crises:

1. Population Growth:

The Earth is finite, but the demands of human population growth act as if resources are infinite. A booming population exponentially increases the consumption of fossil fuels (coal, diesel, petrol) and minerals, leading to systemic pollution, poverty, deforestation, and unplanned urbanization.

2. Deforestation:

Forests regulate rainfall, prevent soil erosion, and recharge groundwater tables. Reckless deforestation to clear land for timber and agriculture has triggered severe climate abnormalities.

3. Indiscriminate Use of Technology:

The unscientific deployment of industrial technologies has disrupted ecological balances and generated massive modern waste streams, such as electronic waste (e-waste).

4. Industrial Development:

Unchecked industrialization has prioritized short-term economic profit over long-term environmental safety, leading to the toxic accumulation of greenhouse gases (CO_2, CO) in the atmosphere.

5. Urbanization:

    The mass migration of populations from rural to urban centers in search of employment has caused a population explosion in cities, resulting in slums, inadequate sewage treatment, and severe municipal waste issues.

6. Poverty:

    Paradoxically, poverty accelerates environmental damage. Deprived populations are often forced to unsustainably exploit local natural resources (like cutting down local wood for fuel or clearing forests for immediate subsistence farming) just to meet basic daily survival needs.

7. Unmindful Exploitation of Natural Resources:

    A general lack of environmental literacy and civic awareness leads to the reckless, short-sighted depletion of finite resources.

8. Unrestricted Agricultural Development:

    The aggressive shift toward chemical-heavy commercial farming, characterized by the abuse of chemical fertilizers and over-irrigation, causes soil salinity, land degradation, and biodiversity loss.

I. Sustainable Development: Evolution and Principles-

    The term Sustainable Development refers to the development of mankind that meets human needs without damaging the environment. The Brundtland Commission Report officially defines it as:

    "Development that meets the needs of the present without compromising the ability of future generations to meet their own needs."

    We enjoy a healthy environment today due to our forefathers' proper and sustainable use of natural resources. Similarly, we must be prudent in exploiting natural resources to ensure they benefit future generations.

    The concept of sustainable development gained significant momentum through various international summits, declarations, and reports.

II. Important International Milestones-

A) The Stockholm Declaration (1972)-

    The United Nations Conference on the Human Environment, held in Stockholm in 1972, enunciated several foundational principles to boost the concept of sustainable development:

1. Right to a Quality Environment:

    Humans have a fundamental right to freedom, equality, and adequate life conditions in an environment of a quality that permits a life of dignity and well-being. Consequently, humans bear a solemn responsibility to protect and improve the environment for present and future generations.

2. Protection of Natural Resources:

    The Earth's natural resources—including air, water, land, flora, fauna, and representative samples of natural ecosystems—must be safeguarded for the benefit of present and future generations through careful planning and management.

3. Maintaining Renewable Resources:

    The Earth's capacity to produce vital renewable resources must be maintained and, wherever practicable, restored.

4. Safeguarding Wildlife Heritage:

    Humans have a special responsibility to safeguard and wisely manage the heritage of wildlife and its habitat, which are currently gravely imperiled.

5. Guarding Non-Renewable Resources:

    The non-renewable resources of the Earth must be employed in such a way as to guard against the danger of their future exhaustion and to ensure that all mankind shares the benefits of such employment.

6. Halting the Discharge of Toxic Substances:

    The discharge of toxic substances or other materials, as well as the release of heat in quantities or concentrations that exceed the environment's capacity to render them harmless, must be halted to ensure that serious or irreversible damage is not inflicted upon ecosystems.

7. Enhancing Development Potential:

    The environmental policies of all States should enhance, rather than adversely affect, the present or future development potential of developing countries. They should not hamper the attainment of better living conditions for all.

    Furthermore, the Declaration made provisions for rational planning, human settlement management, the application of technology to avoid environmental risks, and the spread of environmental awareness.

B) The Brundtland Commission Report (1987)

    The UN General Assembly established the World Commission on Environment and Development (WCED) in 1983, which became popularly known as the Brundtland Commission.

    Its landmark 1987 report, Our Common Future, brought the concept of sustainable development into everyday global discourse. According to the report:

1, Sustainable development integrates economics and ecology into decision-making at all levels.

2. It serves as a strategy that harmonizes conflicting goals of economic development and ecological integrity.

3. It stresses setting balanced goals for economic and social development founded on a world ethic of sustainability.

Caring for the Earth (1991):

    Contributing to this global momentum, the World Conservation Union (IUCN), the United Nations Environment Programme (UNEP), and the World Wide Fund for Nature (WWF) jointly published Caring for the Earth: A Strategy for Sustainable Living in 1991, further spreading worldwide awareness.

C) The Rio Declaration / Earth Summit (1992)-

    The United Nations Conference on Environment and Development (UNCED) was held in June 1992 in Rio de Janeiro, Brazil. As the largest environmental conference of its time, with over 150 participating countries, it is widely known as the Earth Summit.

1. Objective:

    To awaken global consciousness regarding environmental degradation and place international policy on the path of sustainable development.

2. The Rio Declaration:

    The summit adopted a declaration containing 27 principles designed to guide nations toward environmentally sustainable development patterns.

3. Agenda 21:

    The summit adopted a highly comprehensive, far-reaching program called Agenda 21. This document outlines the basis for action, objectives, activities, and implementation methods, emphasizing international cooperation to achieve sustainability.

D) The Kyoto Protocol on Global Warming (1997)

    Held in Kyoto, Japan, this summit targeted the rising threat of climate change. The conference adopted the Kyoto Protocol, a historic treaty requiring industrialized nations to reduce their average annual emissions of six greenhouse gases, including carbon dioxide, methane, and nitrous oxide.

E) The Johannesburg Summit (2002)-

    The United Nations organized a ten-day World Summit on Sustainable Development (WSSD) in Johannesburg, South Africa, in 2002. Popularly known as "Earth Summit Plus Ten," the gathering:

1. Stressed the critical link between fighting poverty and protecting the global environment.

2. Committed member states to building a humane, equitable, and caring global society cognizant of human dignity for all.

3. Adopted the Johannesburg Declaration on Sustainable Development.

III. The Indian Context and the Role of the Judiciary-

    In India, there is robust environmental awareness and ongoing protection efforts at the governmental level. Non-Governmental Organizations (NGOs) also play a vital role. However, the proactive role of the Indian Judiciary in protecting the environment and enforcing sustainable development has been particularly remarkable.

Rural Litigation and Entitlement Kendra v. State of U.P.

Facts: The protection of pristine forests and eco-sensitive zones against unchecked limestone mining activities in the Mussoorie hill range was brought before the Hon’ble Supreme Court of India.

Held: The Supreme Court ordered mining activities in these forest areas to be stopped, ruling that they caused severe ecological imbalances. The Court observed that trees and forest cover are vital for bringing rain and purifying the air, concluding that economic urgency cannot take precedence over ecological stability.

Through this and numerous other Public Interest Litigations (PILs), the Hon’ble Supreme Court and various High Courts have consistently ruled in favor of sustainable development, striking a balance between industrial progress and environmental preservation.
